LITIGATION EXPERIENCE
Mr. Smith has successfully tried cases in federal and state courts.  Most
recently, he was lead counsel for General Motors Corporation in a product
liability suit in Van Zandt County, Texas - Steven Gandy v. GMC and
Lewis Chevrolet.  During the trial, Plaintiffs dropped their claims against
GM.  Mr. Smith, however, continued to participate in the trial as
co-counsel for Lewis Chevrolet.  The result of the trial was a complete
defense verdict.

Mr. Smith has also obtained many significant summary judgments in
advance of trials.  These orders have been predominantly based on the
lack of sufficient controverting scientific evidence.  Mr. Smith was also
instrumental in GM obtaining a complete dismissal of a case pending in
federal court in Alabama as a sanction for spoliation of evidence.
